48 Implementation of the Cape Town Convention in the United Kingdom

After a lengthy consultation process, the Cape Town Convention and the Protocol regarding aircraft equipment (‘the Aircraft Protocol’)1 finally came into force in the United Kingdom on 1 November 2015, pursuant to the terms of the International Interests in Aircraft Equipment (Cape Town Convention) Regulations 20152 (‘the Regulations’).

Under the Regulations the United Kingdom has adopted ‘alternative A’ in relation to the remedies on insolvency available under Article XI of the Aircraft Protocol, which gives creditors certainty as to their ability to recover their secured aircraft after a specific waiting
