40 Priority notice procedure

It is possible for a notice of intention to make an application to register a contemplated mortgage of an aircraft to be entered in the register of aircraft mortgages kept by the Civil Aviation Authority1. This is the priority notice procedure. Where such a notice has been entered in the register and the contemplated mortgage is then made and registered within 14 days after entry of the priority notice, the mortgage will be deemed to have priority from the time when the priority notice was registered2.
