41 Priority by registration

The statutory provisions as to registration of various interests have made considerable inroads into the basic rule as to priorities set out above1. These provisions relate to unregistered land2, registered land3, companies4 and local land charges5.

In the case of unregistered land, non-registration of a registrable matter will render the relevant interest void against a purchaser6 irrespective of whether or not that purchaser has actual or constructive knowledge of the prior interest7.
