5: ENDORSEMENT IN LIEU OF NOTICE

35 Endorsement on trust instrument in lieu of notice

The Law of Property Act 1925 Section 137(4) to (6)1 provides as follows:

  1. ‘(4)    Where, as respects any dealing2 with an equitable interest in real or personal property—

    1. (a)    the trustees are not persons to whom a valid notice of the dealing can be given3; or

      (b)    there are no trustees to whom a notice can be given; or

      (c)    for any other reason a valid notice cannot be served, or cannot be served without unreasonable cost or delay;

    a purchaser4 may at his own cost require that—
