74 Acting while disqualified

It is a serious offence to act as a trustee while disqualified. The penalties are1:

  1. 74.1

        on summary conviction, up to 12 months’ imprisonment or a fine of up to the statutory maximum or both;

  2. 74.2

        on indictment, up to two years’ imprisonment or a fine or both.

In addition, an offender may be required to reimburse the charity any remuneration, benefit in kind, or expenses received from the charity while he was disqualified2.
