73 Duration of disqualification and waiverThe Charity Commission may extend or waive the disqualification for a particular individual, either generally or in relation to a particular charity or class of charities1. Such waiver is likely to be given where the Commission is satisfied that there is no risk to the charity or charities concerned. Where the disqualification is due to disqualification under the Company Directors Disqualification Act 1986, however, and the charity in question is a company or a charitable incorporated organisation, it will be necessary to seek the leave of the court2.
