71 Automatic disqualification

The Charities Act 2011 as amended by the Charities (Protection and Social Investment) Act 2016 disqualifies certain persons automatically from acting as either a charity trustee or a holding trustee for a charity or as an officer, agent, or employee of a charity1. The relevant circumstances include2:

  1. 71.1

        conviction (unless spent under the Rehabilitation of Offenders Act 1974) for an offence involving dishonesty or deception or certain specified offences3;

  2. 71.2

        bankruptcy or sequestration (unless discharged)4;

  3. 71.3

        having made a composition or arrangement5 with creditors, or granted
