44.2 Power to transfer property

Trustees of certain charities may resolve that all the charity’s property should be transferred to another specified charity; or that all the property of the charity be divided between two or more other specified charities1. Trustees of a charity may do so if2:

  1. 44.2.1

        its gross annual income in its last financial year did not exceed £10,000;

  2. 44.2.2

        it holds no land on trust for use for its own purposes; and

  3. 44.2.3

        it is neither an exempt charity nor a charitable company,

and the trustees are satisfied that3:

  1. 44.2.4

        it is expedient in furthering the purposes
