42.1 Protective advice and sanction for actions

The Charities Act 2011 enables the Charity Commission to give protective advice or assistance to trustees of existing charities where it is not clear that the action which they propose to take on behalf of the charity is permitted by the terms of their trusts, or where it is clear that they require formal authority1. These powers are now exercised only where there is no alternative.
