3 Meaning of charity

  1. 3.1

        Under the Charities Act 2011, ‘charity’ means ‘an institution which is established for charitable purposes only, and falls to be subject to the control of the High Court in the exercise of its jurisdiction with respect to charities’1. An ‘institution’ for the purpose of the Act means ‘an institution whether incorporated or not, and includes a trust or undertaking’2.

A ‘charitable purpose’ is defined by Section 2 of the Act as a purpose which:

  1. 3.1.1

        falls within Section 3(1), and

  2. 3.1.2

        is for the public benefit.
