196 Procedure whether land is or is not held on trust for charitable use

In general, the trustees of the charity must carry out the following steps before entering into an agreement1 to dispose of charity land:

  1. 196.1

        obtain and consider the report in writing2 of a qualified surveyor3, instructed by the trustees and acting exclusively for the charity, as to the proposed disposition;

  2. 196.2

        advertise the property for sale (or lease) for the period and in the manner recommended by the surveyor unless he advises that advertising would not be in the interests
