4.9 Applications to change a child’s name by persons without parental responsibility

In theory, the wording of the provisions of the Children Act 1989 dealing with the change of a child’s name whilst under a child arrangements order or care order1 appears wide enough to contemplate applications by persons who do not have parental responsibility. However, such persons will not be able to apply to enrol a deed poll in the Queen’s Bench Division and will need to seek an order from the court under the Children Act 1989.
