The right to compensation for delay pursuant to Council Regulation (EC) 261/2004 is less clear where the delay results from a missed connection where the first flight was delayed for less than three hours but resulting in an overall delay of more than three hours to the entire journey. This situation was first considered by the Grand Chamber of the ECJ on 26 February 2013, in Air France SA v Folkerts1. Mr and Mrs Folkerts flew with Air France, a Community carrier, from Germany to Paraguay via Paris and São Paulo. Their first flight from Germany to Paris was delayed by two and a half hours meaning the Folkerts missed their onwards connections from Paris and São Palo, resulting in an overall delay of eleven hours to their arrival in Paraguay.
