51 Liability for passenger delayThe Montreal Convention 1999 and every version of the Warsaw Convention provides the carrier is liable for damage occasioned by delay in the carriage by air of passengers unless the carrier proves that:51.1 the person claiming the compensation or the person from whom he derived his rights, or the passenger in respect of whom the claim is made, caused or contributed to the damage by his negligence or other wrongful act or omission; or51.2 the carrier and its servant and agents took all measures that could reasonably be required to avoid the damage
