48 Limit of carrier’s liability for death and injury of passengers

Where carriage is governed by the Montreal Convention 1999, no artificial limit or ceiling is imposed on the quantum of the carrier’s liability for death and injury of passengers of the type which is included in every version of the Warsaw Convention. The liability of all European Community air carriers1 is governed by the Montreal Convention by virtue of Council Regulation (EC) 2027/972.

The Regulation also requires Community air carriers to make an advance payment in the event of aircraft accidents resulting in death or injury of passengers3. Without delay,
