44 Excluding Convention rules

Provisions in contracts which seek to relieve the carrier of any liability imposed by the Montreal Convention 1999 and every version of the Warsaw Convention, or to lower any applicable limit of liability, are null and void1. The remainder of the contract remains subject to the applicable Convention. In the case of carriage governed by the Warsaw Convention as amended by the Hague Protocol and Montreal Additional Protocol No 4 1975, the rule does not apply to provisions governing loss or damage resulting from the inherent defect, quality or vice of cargo carried2.
