39 Carriage to which neither the Montreal Convention nor the Warsaw Convention system applies

Certain Warsaw Convention system instruments may not apply because they have yet to secure sufficient ratifications to enter into force1. In the case of those which are in force including particularly, but not limited to, the Warsaw Convention—in both its original form and as amended by the Hague Protocol of 1955—applicability in each instance will be governed by whether international carriage existed for the purpose of the Convention concerned, as defined therein2.

This is also true of the Montreal Convention of 19993 in the context of cargo
