35 Instruments of the Warsaw Convention system1

The original Warsaw Convention of 19292 entered into force in international law on 13 February 1933. Its main features are:

  1. 35.1

        the creation of a uniform and exclusive system of liability governing the international carriage by air of passengers, baggage, and cargo;

  2. 35.2

        the creation of strict liability for the carrier subject to limited defences;

  3. 35.3

        the limitation of carrier liability to a maximum period of two years;

  4. 35.4

        the limitation of carrier liability to fixed maximum amounts;

  5. 35.5

        the breaking of carrier limits of liability on proof of wilful misconduct;
