34 Introduction

The liability of aircraft operators licensed in the European Union in respect of the carriage by air of passengers and their baggage, and of cargo, is dominated by the Convention for the Unification of Certain Rules for International Carriage by Air, Montreal, 28 May 1999 (Montreal Convention). Various other instruments of international law, which are collectively known as the Warsaw Convention system1, are superseded by the Montreal Convention, but continue to be part of the overall liability regime until the Montreal Convention has been ratified by the all those countries party to the Warsaw
