20 Introduction

The creation of the single market in transport has taken a considerable period of time. Transport by road, rail and inland waterway is a specific policy area1. Issues of unfair competition and abuse of a dominant situation are not dealt with by the ordinary mechanisms under Articles 101 and 102 of the Treaty on the Functioning of the European Union (TFEU), but by a specific Council Regulation2. In relation to rail transport, the EU institutions have largely confined themselves to facilitating co-ordination between train operating companies in the various member states.
