Employees who are transferred to a new employer on a business sale may well be concerned lest the new employer seeks to impose on them inferior terms and conditions of employment. The Transfer of Undertakings (Protection of Employment) Regulations 2006 (the TUPE Regulations) seek to ensure that employees are not penalised in this way by imposing limitations on the ability of the transferee and employee to agree a variation to terms and conditions after the transfer has occurred.
