235.2 Effect on collective agreements and trade union recognition

The transferee employer will take over any collective agreements which have been made by, or on behalf of, the transferor employer in respect of any transferring employees and which were in force immediately before the transfer1. Where the transferor employer voluntarily recognised an independent trade union, or unions, in respect of some or all of the transferred employees, then the transferee employer will also be required to recognise that union to the same extent after the transfer takes place2.
