167.5 Sex equality clauses

The Equality Act 2010 provides that, in certain circumstances, the terms of work of an employee or office-holder (A) are to be treated as including a sex equality clause1. This applies where A:

  1. 167.5.1

        is employed on work that is equal to the work that a comparator of the opposite sex (B) does2, or

  2. 167.5.2

        holds a personal or public office and does work that is equal to the work that a comparator of the opposite sex (B) does3.

For these purposes, A’s work is equal to that of B if4 it is like B’s work5, rated
