159 The written statement of terms

159.1 Inadequacy as a contract substitute

As mentioned above1, it is the duty of an employer to provide an employee with a written statement of certain terms of employment within two months of his commencing work2. The fact that the employer is required to provide this written statement may lead to a client asking why he should not just rely upon this statement rather than going to the expense of having a properly drafted written employment contract.

One of the reasons is that the written statement does not necessarily have all the characteristics of a contract
