150.5 Aggressive commercial practices

The prohibition on aggressive commercial practices is set out in the Consumer Protection from Unfair Trading Regulations 2008 regulation 7. A commercial practice1 is aggressive if, in its factual context and taking account of all of its features and circumstances, it:

  1. 150.5.1

        significantly impairs or is likely significantly to impair the average consumer’s freedom of choice or conduct in relation to the product concerned through the use of harassment, coercion2 or undue influence3, and

  2. 150.5.2

        thereby causes or is likely to cause him to take a transactional decision4 he would not have taken otherwise5.
