141.4 The terms of the lease

A business which is a prospective tenant may be in a stronger position to negotiate the terms of the lease offered by the landlord than the proprietors may think. This is because the landlord will wish to see its premises occupied and producing an income, so it will value potential tenants accordingly.

It has already been stated that proprietors of the tenant business should resist any attempt by the landlord to persuade them to accept a term in the lease excluding the statutory security of tenure under the Landlord and Tenant Act 19541. The proprietors
