37 Use of disused burial grounds

The most frequent use of disused burial grounds is as open spaces, and this is specifically authorised by the Open Spaces Act 19061. In addition, many local authorities have obtained local Act powers to permit parts of burial grounds to be improved and maintained as gardens without becoming public open spaces in the ordinary way2. Certain statutory provisions authorise the use of burial grounds for planning purposes under town planning legislation or in connection with civil aviation or new towns3.
