34 Dispensation from authority for disinterment under planning legislation

Subject to compliance with regulations, neither a licence of the Secretary of State nor a faculty is required for disinterment (usually of a number of bodies rather than a single exhumation) under town planning legislation1 or the legislation relating to civil aviation2, new towns3, the national health service4 and the Homes and Communities Agency5. There are bespoke regimes which allow for disinterment for certain infrastructure works taking place under the authority of an Act of Parliament6.
