28 Exclusive rights of burial in churchyards

Exclusive rights of burial cannot be reserved in a churchyard save by a faculty1, apart from the reservation by a donor of land for an addition to a churchyard of up to one-sixth of the area donated as a burial place for themself and their family under the Ecclesiastical Jurisdiction and Care of Churches Measure 20182.

Strictly speaking, a faculty is also required for the erection of any monument in a churchyard, but in practice the consistory courts leave it to incumbents to grant
