92 Contract provisions for claims

Most modern construction contracts provide specific machinery for the assessment and payment of compensation to contractors1 for certain financial losses suffered when the contract works are prolonged or otherwise disrupted2. Such provisions apply in the main to circumstances which would in any event constitute a breach of contract by the other party. Where this is so, the rights provided by the contract are presumed to be additional to the normal remedy of damages for breach of contract3.
