67 Reasonable sum or quantum meruit

The expression quantum meruit, meaning ‘as much as he deserved’, has in the past been used to describe claims to be paid a reasonable sum in respect of work carried out. Such claims may be contractual or restitutionary in nature1. They will be contractual where there is a contract which defines the work but does not fix a price2, or where work is carried out at the request (express or implied) of the employer3.
