5 Design and build contracts

A design and build contract, also known as a ‘package deal’ or ‘turnkey contract’, is one under which the contractor undertakes both to design and to construct the contract works, which are to be completed in such a way as to meet the requirements of the employer. The most important principle of such a contract is that, while either design or construction may in fact be sub-contracted, the contractual responsibility for both aspects of the work rests with the contractor1.
