3 Roles of the parties

In addition to the employer and the contractor, the operation of a construction contract commonly involves a number of other persons not party to the contract itself. Except where the contractor undertakes to design as well as to construct the works1, the employer will usually commission the design from a professionally qualified architect2 or engineer3, whose rights and obligations in respect of the design will be governed by the contract (commonly referred to as an appointment) under which he is engaged.
