13 Public works contracts

Contracts with government departments and certain local and public authorities are, with some exceptions, subject to European Union directives governing the tendering procedures to be used for the award of public works1, supply2 and services3 contracts4. Similar rules apply to private utility companies in the transport, energy, water and telecommunications sectors5. The directives have each been implemented by national legislation6, allowing individuals and companies discriminated against during a public works tender to claim compensation or a rerun of the tender process through the national courts7
