107 Contributory negligence

In a claim by the employer against the contractor, or by the contractor against the employer, the damages recoverable may fall to be reduced on account of the fault of the party claiming. The Law Reform (Contributory Negligence) Act 19451 provides that where a person suffers damage partly as a result of its own fault2 and partly of the fault of another person, the damages recoverable shall be reduced to such extent as the court3 thinks just and equitable.
