104 Control of noise

A local authority has special statutory powers to control nuisance by noise on construction sites1. These include the power to serve a notice imposing requirements as to the way in which construction and other works are to be carried out2. Compliance with such a notice does not prevent an aggrieved party from obtaining an injunction which imposes more restrictive conditions3. Moreover, failure to comply with a notice may lead to an injunctive remedy in addition to the criminal penalties imposed by the statute4.
