102 Enforcement of health and safety legislation

The Health and Safety at Work etc Act 1974 and the Construction (Design and Management) Regulations 2015 are both administered and enforced by the Health and Safety Executive (the ‘HSE’). The HSE has rights of inspection and the right to serve an ‘improvement notice’1 or a ‘prohibition notice’2 with penalties for breach of such notices. It also acts as enforcement authority for the purposes of bringing health and safety prosecutions against companies and individuals.

The HSE publishes Approved Codes of Practice and enforcement policies which assist in interpreting the legislation and predicting the action
