8.3 Purpose of including definition

Sometimes, references to affiliates or group companies are included in a contract to enable them to receive a benefit under the contract. Unless careful consideration is given to the drafting of such a provision, it may not be clear who is or is not a party to the contract. In general, if a person is to be a party to the contract, he should be named as a party, and/or his agent (or, in the case of a company, an authorised signatory) must sign the contract.
