73.3 Exceptions to application of the Act

The Contracts (Right of Third Parties) Act 1999 does not apply to all contracts. In particular:

  1. (a)

        it does not apply to any contract made before 11 November 19991;

  2. (b)

        it does not apply to a contract made between 11 November and 10 May 2000 unless the parties expressly agree to apply the 1999 Act2;

  3. (c)

        certain categories of contract are automatically excluded from the 1999 Act, for example contracts of employment3; and

  4. (d)

        the 1999 Act only grants rights to a third party who meets
