73.15 Third party rights distinct from the Act

The Contracts (Rights of Third Parties Act) 1999 Section 1 does not affect any right or remedy of a third party that exists or is available apart from that Act1.

A third party can enforce a right or use a defence available in a contract made by the contracting parties, if such rights or defences are available as exceptions to the doctrine of privity of contract (whether they are available at common law, in equity or under other legislation other than the 1999 Act); or if they fall outside the scope
