72.1 Purpose

There are a number of documents which precede, occur during the life of, or are created on termination or after termination of, a commercial agreement. Such documents fall mainly into the following groups:

  1. (a)

        Heads of terms: These are documents which record the intentions of the parties wishing to enter into an agreement. The usual key distinguishing feature is that the parties do not wish to be bound by the document or any of the provisions found in the document.
