70.7 Improper performance

A relevant function or activity is performed improperly it is performed in breach of the expectations that the person carrying out will do so in good faith or impartially; or in breach of any expectation as to the manner in which, or the reasons for which, the function or activity will be performed that arises from the person being in a position of trust1. The function or activity is to be treated as being performed improperly if it is not performed and that failure to perform is in itself a breach of any of the above
