70.6 Relevant activities and functions

An activity or function to which a bribe relates is ‘relevant’, if it1:

  1. (a)

        falls within a defined list of functions or activities; and

  2. (b)

        fulfils one of three conditions, whether or not it has any connection with, or is performed in, the United Kingdom.

The Bribery Act 2010 has a wide definition of ‘function’ and ‘activity’ and covers both the public and private sector.

  1. (c)

        The term ‘function’ covers any function which is of a public nature2.

  2. (d)

        The term ‘activity’ (which includes a trade or profession3) covers
