7.2 Definitions clause

The following conventions are used in commercial agreements drafted by English lawyers:

  1. (a)

        The definitions in an agreement can be located in different places in an agreement.

    A separate ‘Definitions’ clause with all defined terms, together with their definitions, is usually placed at the beginning of the operative provisions, usually as clause 1. The advantage of this location is that the user of the agreement can find the definitions easily.
