63.2 Drafting issues—announcements

Some of the issues that a contract drafter may need to consider, when drafting an announcements clause, are:

  1. (a)

        Are announcements allowed? Can press or other public announcements about the agreement, or any aspect of it, be made?

  2. (b)

        Can press or other public announcements be made:

    1. (i)

          as agreed by the parties, or

    2. (ii)

          when a particular event, achievement or milestone is achieved (for example if the parties are developing a product, when the product is ready for sale)?

  3. (c)

        Who will make such announcements?

  4. (d)

        Does the party wishing to make the announcement require the
