52.3 Drafting points—insurance clause

  1. (a)

        Does a party need to have insurance?

    1. (i)

          Is a party required to state that they have taken out or have in force an insurance policy?

    2. (ii)

          Is a party required to indicate that the policy is with a ‘reputable’ insurance company? For some industry or service sectors, there may be a limited number of insurers or insurance brokers available. Whether they are reputable or not, the party seeking insurance may have no but choice to deal with them.
