3.3 Legal name and status of parties

The main purpose of stating the legal name and status of a party fully is to be clear as to their identity. It may also reveal any issues which may arise in relation to their capacity to enter into contracts, and which may need to be investigated further (for example, if a party is an unincorporated trust, whether it has the legal capacity to enter into a contract of the type contemplated). The following points need consideration:
