(a) Introduction to termination

23.1 Types of termination provisions

A termination provision in a contract will typically fall into one of the following categories:

  1. (a)

        termination ‘by effluxion of time’, for example, if the contract is stated to be for a fixed period of time. In this case,

    1. (i)

          termination will occur at the end of that period; or

    2. (ii)

          the contract may automatically renew for a further fixed period with the opportunity for a party not to renew, for example, by the party giving notice of such an intention, and on
