20.2 Drafting points—agreement date

By convention, the date of the agreement is stated at the beginning of the agreement text, above the names of the parties. The exact words differ from precedent to precedent; two examples follow.

‘THIS AGREEMENT is made on the 14th day of July 2001 BETWEEN:’

or:

‘This agreement dated 14 July 2001 is made by and between:’

Although the date is typed in the above examples, the convention amongst (by now some) English lawyers is to leave the date blank until the agreement has been signed, then write in the date by hand. If the parties’ solicitors are involved at
