19.2 Distinguishing date of agreement and commencement date

If the commencement date is to be different from the date on which the agreement is signed (or a deed is delivered), this needs to be clear in the wording of the contract. The best way of doing this is to include:

  1. (a)

        a definition of ‘Commencement Date’ in the definitions clause, which states the date when the agreement is to come into force; and

  2. (b)

        an operative provision that states specifically that the agreement comes into effect on the commencement date:

    1. ‘This agreement shall come into effect on the Commencement Date’
